Terms and Conditions

  1. AGREEMENT TO TERMS These Terms and Conditions constitute a legally binding agreement made between you (“Client”) and aLaPony LLC (“aLaPony LLC,” “we,” “us” or “our”), concerning the video production, drone, and 3D modeling services (“Services”) provided by aLaPony LLC to the Client. By engaging aLaPony LLC, you agree that you have read, understood, and agreed to be bound by all these Terms and Conditions. 
  2. SERVICES AND PROPOSAL aLaPony LLC provides professional video editing, FAA-certified drone services, and 3D real estate modeling utilizing the Insta360 X5 8K camera. 
  • Creative Tools: The tools used may include Adobe Premiere Pro, Adobe Photoshop, and Matterport software. 
  • Stock Assets: We provide access to an extensive, world-class library of creative assets. You have the freedom to select songs and music from either Adobe Stock or Musicbed, offering you thousands of professional tracks to explore. With such a vast selection, we are confident you will find a piece of music you truly love that perfectly fits your project's vision. Please note that depending on the specific track or license selected, some choices may increase the final proposed amount.
  • Scope of Work: Specific deliverables, timelines, and fees will be detailed in a separate “Proposal.” Proposals are valid for two (2) weeks from the date of issue. 
  • Content Restrictions: We reserve the right to refuse projects involving assets we deem illegal, obscene, or offensive. 
  1. CLIENT-PROVIDED ASSETS The Client warrants that they have all necessary permissions and licenses for any materials (photos, videos, music) they provide to aLaPony LLC for inclusion in a project. The Client agrees to indemnify aLaPony LLC against any legal claims arising from the use of these materials.

  2. PAYMENT TERMS AND REFUND POLICY Due to the custom nature of video and 3D production, all sales are final. No refunds are offered once work has commenced. 
  • The Process: 1. Deposit (Down payment required to proceed); 2. Draft Production; 3. Finalization (Review of final draft); 4. Final Payment (Remaining balance collected upon approval). 
  • Completion: Once the final draft is approved and payment is processed, the project is complete and non-refundable.
  1. SHIPPING AND DELIVERY
  • Digital Delivery: Primary delivery is via a shared cloud folder or direct download link at no additional cost. 
  • Physical Media: If physical media (tapes, hard drives) are required, the Client pays inbound shipping to our P.O. Box. aLaPony LLC covers standard outbound shipping for the return of media. We are not liable for items lost or damaged by third-party carriers. 
  1. INTELLECTUAL PROPERTY RIGHTS Upon final payment, aLaPony LLC grants the Client all rights and interest in the final deliverables. aLaPony LLC retains the right to use final work and behind-the-scenes material for promotional and portfolio purposes unless explicitly denied in the Proposal. All project working files remain the property of aLaPony LLC. 
  2. PROJECT PAUSE AND REACTIVATION Timely feedback is required. If a Client fails to provide feedback or assets within 7 calendar days of a request, the project will be placed “On Hold.” A $110 re-activation fee may be required to resume work. 
  3. GOVERNING LAW AND DISPUTES These terms are governed by the laws of the State of Ohio. Any legal actions shall be prosecuted exclusively in the state and federal courts located in Lorain County, Ohio. 
  4. LIMITATIONS AND LIABILITY Services are provided on an "as-is" basis at the Client's sole risk. aLaPony LLC and its agents shall not be liable for any direct, indirect, or consequential damages, including loss of data or lost profits, arising from the use of our Services.
